If your injury was at least partly because of another driver’s negligent driving, you can claim compensation. You can still claim compensation even if the other driver was not insured or you think they don’t have enough money to pay you compensation. The Motor Insurers’ Bureau (MIB) may pay you compensation if the other driver:
- didn’t have insurance; or
- cannot be found (for example, if you were injured in a hit-and-run accident).

What if an insurance company contacts me with a compensation offer?
Sometimes the insurance company for the organisation that was responsible your injuries may contact you direct with an offer of compensation. This is most likely to happen in the case of a road accident, but it could be for another situation where you were injured.
If this happens to you, it is important that you seek legal advice from a solicitor, or possibly a claims management company, before accepting any offer - even if the offer seems generous or the insurer says they will make a quick payment.
Remember that the insurance company that has contacted you is working for the company you have a claim against, and it is in their interests to persuade you to accept as little compensation as possible, as quickly as possible.
If you ask a solicitor or claims management company to take your case, they will act in your interests. They will tell you how the compensation you have been offered compares with what they think you should be paid, and may be able to negotiate a larger sum.
